Terms of Service

Speedway Refrigeration & Appliance Repair
Effective Date: March 2, 2026

By scheduling service, requesting diagnostics, approving repairs, or using our website, you agree to the following Terms of Service.

1. Scope of Services

Speedway Refrigeration & Appliance Repair (“Company”) provides residential and light commercial appliance diagnostics, maintenance, and repair services.

Services are limited to appliances located within our service area and accessible under safe working conditions.

We reserve the right to refuse service for safety, legal, or operational reasons.

2. Service Call & Diagnostic Fee (Non-Refundable)

An $80 service call and diagnostic fee is required for all on-site visits.

This fee covers:

Travel time
Technician labor for diagnosis
Inspection and testing
Written or verbal estimate

The diagnostic fee is non-refundable once the technician arrives on site.

If repair is approved during the same visit, the diagnostic fee will be credited toward the repair total.

3. Estimates & Authorization

All repair estimates must be approved before work begins. Approval may be verbal, electronic, or written.

Once approved, the customer authorizes the Company to order parts and perform labor.

If parts are ordered and the customer cancels:

The customer is responsible for the full cost of special-order parts.
Restocking fees may apply (typically 20–35% depending on supplier).
Shipping costs are non-refundable.

4. Payment Terms

Payment is due immediately upon completion of service unless otherwise agreed in writing.

Accepted forms of payment:

Cash
Check
Zelle
Quick Pay

Returned checks will incur a $35 fee or the maximum allowed under Michigan law.

Failure to pay may result in:

Collection efforts
Reporting to collections agency
Legal action
Filing of a construction lien where applicable under Michigan law

Customer agrees to pay reasonable collection costs and attorney fees permitted by law.

5. Refund Policy

Refunds are not provided for:

Diagnostic fees after technician arrival
Completed labor
Installed parts
Special-order parts

If a repair is found defective within the warranty period, the Company will re-inspect the appliance and repair the specific covered issue.

Refunds will only be issued at the Company’s sole discretion and only if repair correction is not reasonably possible. Food loss, lost wages, inconvenience, or secondary damages are not refundable.

6. Warranty (Limited)

Labor Warranty: [Insert 30–90 days]
Parts Warranty: Manufacturer warranty applies.

Warranty excludes:

Power surges
Electrical supply issues
Plumbing issues
Clogged vents or drains
Improper installation by others
Misuse or neglect
Pre-existing conditions
Rust or corrosion
Rodent or insect damage
Acts of God

Warranty is non-transferable, valid only for the original customer, and limited strictly to the repaired component.

7. Limitation of Liability

To the fullest extent permitted under Michigan law, Speedway Refrigeration & Appliance Repair shall not be liable for:

Loss of food
Loss of income
Business interruption
Property damage beyond the appliance
Incidental or consequential damages
Emotional distress
Delays due to part availability

Maximum liability shall not exceed the amount paid for the specific service performed.

8. Appliance Condition Disclaimer

Customer acknowledges that the appliance may have pre-existing wear or hidden defects. Disassembly may reveal additional failures, and repair of one component does not guarantee full future performance.

Older appliances may fail due to normal wear after repair. The Company is not responsible for unrelated subsequent failures.

9. Access & Safety Requirements

Customer must:

Provide safe and unobstructed access
Secure pets
Ensure someone 18+ is present
Disconnect water lines or gas lines if instructed

The Company may refuse service if conditions are unsafe.

10. After-Hours Service

After-hours service is subject to availability and additional fees.

11. Indemnification

Customer agrees to indemnify and hold harmless Speedway Refrigeration & Appliance Repair from any claims, damages, or losses resulting from pre-existing appliance defects, improper installation by others, utility issues, or misuse after repair.

12. Michigan-Specific Legal Protections

This agreement is governed by the laws of the State of Michigan. Under Michigan law:

The Company may pursue civil remedies for non-payment.
Mechanic’s lien rights may apply under the Michigan Construction Lien Act where permitted.
Venue for any legal dispute shall be in the county where service was performed.
Customer waives jury trial rights to the extent permitted by Michigan law.

13. Dispute Resolution & Arbitration Clause

Any dispute arising out of or relating to services provided shall be resolved as follows:

The parties agree to attempt good-faith resolution first.
If unresolved, the dispute shall be submitted to binding arbitration in the State of Michigan.
Arbitration shall be conducted under the rules of the American Arbitration Association (AAA).
Each party shall bear its own legal fees unless otherwise awarded by the arbitrator.
Arbitration replaces the right to go to court or have a jury trial.

14. Force Majeure

The Company is not responsible for delays caused by supplier shortages, weather, acts of God, utility outages, or government restrictions.

15. Website & Communication

By submitting a form or contacting the Company, customer agrees to receive appointment confirmations, service updates, invoices, and follow-up communication. We do not sell customer data.

16. Changes to Terms

The Company reserves the right to update these Terms at any time. Continued use of services constitutes acceptance of the revised Terms.
